Terms of service

Agreement

By placing an order you agree to these terms, the licence terms and the refund policy. We update them from time to time; the version in force for your order is the one published on the date you ordered.

Orders and pricing

All prices are in US dollars. Digital products are not subject to shipping charges. Where sales tax applies it is calculated at checkout from your billing address. We reserve the right to cancel and fully refund an order placed at a price published in error.

Payment

Payment is captured when your order is placed. Card details are entered directly into a hosted, encrypted field and exchanged for an opaque token; our systems receive only the card brand, the last four digits and the expiry. We never see or store a full card number.

Delivery

Products are delivered electronically, immediately on payment, to the email address given at checkout. It is your responsibility to give an address you can receive mail at. If links do not arrive within an hour, email hello@hlxmarketing.com and we will send them by hand.

Accounts and access

Download links are personal to the purchaser and the licensed brand or organisation. We may disable links that are being distributed publicly.

What we do and do not promise

Products are professional tools drawn from real client work. They are supplied as-is. We describe each one's contents and format accurately and stand behind that description with the refund policy above — but we cannot and do not promise a commercial result, because that depends on your offer, your market and your execution far more than on any file.

Studio engagements

Client services are governed by a separate signed agreement covering scope, schedule, fees and intellectual property. Nothing on this site constitutes an offer of services or a quote.

Acceptable use

Do not use the site or its products to break the law, infringe anyone's rights, or produce material that is deceptive, harassing or unlawful. We may refuse or cancel an order at our discretion and refund it.

Liability

To the fullest extent permitted by law, our liability for any claim relating to a product is limited to the amount you paid for that product. We are not liable for indirect or consequential loss, including lost profits or lost business.

Governing law

These terms are governed by the laws of the State of Texas, and the courts of Texas have exclusive jurisdiction.
